Sustain Pedal issue when recording

I've seen another post about this but not sure if there's been anything conclusive on it. When recording a pattern, using the sustain pedal the recording at times doesn't play back with the sustain.

I read that it could be because the event of pushing the sustain down, if done before the recording starts, doesn't register. But I have tried to deliberately wait until the recording starts and I still get the issue.

Firstly, should this not be reprogrammed to be a state instead of an event - the state being pedal down or up - to prevent this issue?

Wondering if anyone else has experienced this and found a solution? Wanting to do some live looping in a month using the pattern functionality and it's really frustrating that I can't get a consistent result.
